Addendum A (Revised 2-19-07) CONSTRUCTION All building material will be of #2 grade or better. 8' Ceilingson 1st level of all homes FOUNDATION Concrete footings per plan. 8" concrete walls per plan. 3" to 4" floor slab per plan. Builder installs 3" vent pipe in basement floor, through roof for future radon system if needed. ROOF Rafter and floor joists are 2"x8", 16" on center. Ceiling joists are 2"x6", 16" on center (larger if code requires). 1/2" C.D.X. Fir on 5/8" O.S.B. roofing per Builder discretion. Roofing felt installed between sheathing and 25 year shingles. Shingle color is standard Black, No color choice available. EXTERIOR SIDING Vinyl siding is Buyers choice from Builder selection, if house not already sided. Facia to be wrapped in metal and painted wood trim around garage door and exterior doors. EXTERIOR WALLS & DOORS All exterior walls will be of 2"x6" construction, 16" on center with 7/16" Sheathing. Insulated metal doors. Vinyl clad sliders (no grills) as per plan. WINDOWS & SHUTTERS "Rivco" or equivalent vinyl thermal tilt outs with screens and grills. Shutters are vinyl and installed in front of home per plan. ENTRANCE STEPS, DRIVEWAY & WALKWAY Pre-cast concrete front steps. All steps in excess of 3 risers shall have iron railings. Use of salt not recommended. Railings should be painted annually. Wood front steps on all Farmers Porches comparable to material used. Asphalt paved driveway and walkway to front steps. Should paving not be able to be completed prior to closing due to weather conditions, Buyer has the option of receiving a Builder credit or waiting until weather conditions are satisfactory to install paving. No monies will be placed in escrow at closing. WELL & SEWER Water is supplied municipal water and monitored by Manchester Water Works. Private Septic System FLOORS & INTERIOR STAIRS Kitchen: 3/4" tongue and groove Fir plywood. All others 3/4" tongue and groove O.S.B. glued and nailed. Stairs to be plywood covered with carpet. INSULATION 6" (R-19) in the walls, 9" (R-30) in the ceilings, and 3 1/2" (R-11) in the bastment ceiling CATHEDRAL CEILINGS As per plan. Homes already framed are "as is seen". INTERIOR DOORS & TRIM Painted 6 panel interior masonite doors with painted colonial casing. Trim is painted. Crown Molding and Chair Railing is to be installed in the dining room. PAINTING Interior Trim: One coat primer and one coat Sherwood Williams, Coral White, Semi-Gloss. Interior Walls: One coat white latex primer, one coat Coral White Flat paint to finished walls. Ceilings: Textured Exterior: Front door color is Buyer's choice from Builder's selection. Standard color for garage overhead door - color is white. Buyer may choose a different color for an upgrade charge. CABINETS Standard Kitchen and Bath Cabinet layout is "U" shaped with a 7' peninsula on one end. Crown Molding on cabinet tops is includd. Standard Cabinet is a Raised Panel Oak. Countertops can be seen and chosen through Rivco Cabinet Company, Nashua NH, Buyers choice from Builder's Suppliers selection, unless already chosen and ordered by Builder. Optional upgrades are available through the Builder. FLOORING Standard carpet and pad is $16.00 per Sq.Yd. installed. Standard vinyl is $18.00 per Sq. Yd. installed. Sub floor for vinyl floors to be installed in all baths and kitchen. Flooring must be chosen through R&S Carpet, Hudson, NH. Hardwood is standard in the dining room and foyer. Optional Hardwood flooring is available through Builder. Standard color is Pre-Finished oak. If Buyer chooses not to have standard hardwood, a credit will be issued at closing for materials only. FIREPLACE & FLUE Zero Clearance Metal Insert LP Gas with direct power vent outside, no chimney. Standard 3 piece Slate inserted on wall and 1 peice floor. Standard wood mantle painted white. Blower is opitonal. Buyer may be required to sign lease for propane tank. Fuel left in storage tank will be prorted as of closing date. Builder reserves the right to utilize the additional flue in the basement (if any) for purposes of venting the hot water tank or furnace. HEATING Forced Hot Air by Gas, 2 zones, separate 40 gallon electric Hot Water heater. Furnace placement will be determined by Town Building Code,, and the heating sub-contractor and is not negotiable. Fuel left in storage tank will be prorated as of closing date. Buyer will be required to sign a lease for propane tank. SMOKE DETECTORS Builder will supply and install one electric smoke detector to all levels of the dwelling (first, second and basement) and in all bedrooms. ELECTRICAL A standard 200 amp service will be installed in accordance with the electrical service required. Six telephone outlets (Kitchen, family room and all bedrooms) and five cable outlets (Family room and all bedrooms) are included. These will be placed at the discretion of the Electrician. Four recessed lighting cans to be installed in kitchen ceiling on dimmer switch. Location to be determined by the Electrician. Two exterior outlets are included and placed per code. LIGHT FIXTURES Lighting is a standard Builders package of white on white lighting fixtures. Master Bedroom (if Cathedral ceiling) and Family room (if cathedral ceiling) to be wired for Ceiling Fan/Light fixtures, with 2 wall switches. Buyer to provide Ceiling fan/light fixture and bulbs. For variable speed fans, we suggest remote controls. Buyer to mark box with note on which side of fan blade to be facing down and any specific instructions. Buyer is responsible to deliver fan to house when needed or may be subjectto a service fee. One flood light over the garage exterior, and 4 to 6 ceramic fixtures in basement ceiling determined by floorplan. Main and Master baths to have exhaust fan with lights. All bedrooms to have an overhead with one switch. Celing fan outlets are an upgrade. APPLIANCES & PLUMBINGAppliance allowance is $750.00 (Seven hundred and fifty dollars). Electric Range, Hood fan, and dishwasher to be selected with Fletcher Appliance, Nashua NH. Copper and plastic piping will be used for all water and heat lines. PVC will be used for all drain and sewer lines. TUB AND SHOWER UNITS A 5' fiberglass tub/shower unit will be installed in all full bathrooms. A 4'x3' shower unit will be installed in Master Bathrooms. Fixture color: White is standard, Almond is an upgrade. VANITIES & SINKS Main bath will have a 48" matching cabinet vanity with a single bowl porcelain sink per plan. Master Bath will have a 48" matching cabinet vanity with two single bowl porcelain sinks. Half bath will have a 30" matching vanity with a single bowl porcelain sink. Mirrors over the vanities are not included. Standard Kitchen sink will be single bowl stainless steel with hand held sprayer. GARAGE Two car garage under or attached as per plan. Standard door size is 7' high and 8' or 9' wide, dictated by the plan. Insulation is only provided in areas required by local building code. A garage door opener will be provided on each door with wall button by main door to house. ATTIC Scuttle access is provided through a bedroom closet, per code and at the discretion of the Builder. DECK & LANDSCAPING One 12'x12' deck will be constructed as per plan. Stair location will be determined by Builder. All deck materials will be pressure treated. Due to the nature of the materials, the Builder will not paint or stain the deck. Builder shall rake, fertilize and seed all disturbed areas around the home. The Builder shall not be responsible for grass growth. You will be started with a loam base with seed. Buyer is responsible for watering, and fertilizing lawn. There is no warranty for landscaping. If transfer of title occurs during the time of year the Builder is unable to complete landscaping, the Buyer has the choice of receiving a $600 (Six hundred dollar) credit or wait until the dry season for the work to be completed. No monies shall be placed in escrow. MISCELLANEOUS All selections will be made from the Builder's standard and upgrade selections except those that will be made from the Builders flooring, cabinet and appliance suppliers. Any additional upgrde costs will be made per Supplier's terms. All Selections should be made within ten (10) days of signing contract. Upgrades: Buyer agrees that any and all upgrades shall be paid for up front, are non refundable and become the property of the Builder should the property not close on the contract date or a mutually agreed upon date. Should the Buyer choose to finance any upgrades the following shall apply: Buyer will ensure that the deposit left with The Prudential Verani Realty, Escrow agent, shall be enough to cover the upgrades that are financed. That amount of the deposit is non refundable and is the property of the Builder should the property not close on the contract date or a mutually agreed upon date. Cabinet, Flooring and Appliance upgrades tht are financed will carry a 15% additional surcharge of the total paid in advance to the Builder. If for any reason a selection is not included in the completed home, the Builder's responsibility is limited to refund the price of the selection to the Buyer. Excavation: Seller reserves the right to either increase price or void agreement on homes sold prior to excavation work being done, due to possbilities of ledge and unexpected costs. Should buyer not agree to increase in price they may rescind the contract and have full deposit monies refunded and neither party shall have any recourse on the other. Escrows: Builder policy does not allow any Builder funds to be placed in escrow for seasonal items that do not get completed. (Landscaping, Exterior painting, Paving etc.) At the time of closing, Buyer will have the choice of taking credits for such items or allowing the Builder to return and complete the work when the dry wether permits. The Buyer agrees to assume all responsibility in regard to working through this issue with their finance company. Existing Homes: Homes that are already constructed may have been built without some of the above mentioned features and therefore are being sold 'as is, as seen'. Automatic 30 day extension: Builder reserves the right to an automatic 30 day extension on closing date if needed. Non-refundable Deposit: At bank Commitment and start of construction, Buyers deposit shall become non-refundable and the property of the Seller. This document shall act as sole release for the escrow Agent to do so. Closing Location and Attorney or Title Company: Closing to take place at Prudential Verani Realty in Londondery NH. Closing shall be performed by a NH Attorney or NH Title Company. Possession: Upon receipt of Sellers proceeds by certified funds, Seller will release house keys and give occupancy. Accompanied Visits: While visits to the property during construction phase is encouraged, being accompanied by your agent is required. Addendum A Specifications of Construction: Certain conditions in Addendum A supercede any attached Purchase and Sales Agreement. Liquidated Damages: If the Seller h as substantially completed the house in accordance with the terms of the Purchase and Sales Agreement, including and excluding any exterior work which cannot be completed as a result of winter conditions and if the Buyers do not proceed to purchase the property and delays the closing, the Buyers shall be responsible to pay the Seller, Eight Dollars ($80.00) per diem during any such period of delay. Any Additions made after Purchase and Sales Agreement and Selection Sheets have been fully executed by all parties, must be paid for in advance by the Buyer, are subject to a $200.00 change order fee and ar non-refundable, on Acceptance of the Change by the builder. According to NH Law RSA 359-G contains important requirements that you must follow before you may file as lawsuit or other action for defective construction against the contractor who constructed, remodled or repaired your home. Sixty days before you file your lawsuit or other action, you must serve on the contractor a written notice of any construction conditions you allege are defective. Under the law, a contractor has the opportunity to make an offer, to repair and/or pay for the defects. There are strict guidelines and procedures under state law, and failure to follow them may affect your ability to file a lawsuit or other action. Seller reserves the right to change his sub-contractors, at any time, at his discretion, and without notice to Buyers.
